You are only authorized to use the services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and regulations, and the terms and conditions of this Agreement. II. COLLECTION & USE OF PERSONAL DATA

If you attempt to use the services and applications of the website and/ or choose to provide information, this website shall collect Personal Information from you. This information includes, but is not limited to: name, address, telephone number, mobile number and/or email address. You must qualify that you are 18 years or older and must be responsible for keeping your password secure and be responsible for all activities and contents that are uploaded under your account. You must not transmit any worms or viruses or any code of a destructive nature. Privacy is a paramount concern, and all reasonable efforts will be undertaken to protect any personal information you disclose. VIII. MINORS

This website is not intended for visitors that are minors or under eighteen (18) years of age. ETT does not knowingly solicit or collect information from individuals under the age of eighteen (18). If it is determined that personal information from someone under eighteen (18) years of age has been inadvertently collected, reasonable steps to purge this information from the database will be taken. Parents and guardians are encouraged. to spend time online with their children and to participate and monitor the Internet activities of their children.

ETT reserves the right to change or update these Terms of Use at any time by posting a clear and conspicuous notice on the website. All software is provided to you as-is, and there are no warranties, claims or representations made by ETT or its suppliers, either express or implied, or statutory, with respect to the software, including warranties or conditions of title, quality, performance, noninfringement, merchantability, or fitness for a particular purpose, nor are there any warranties created by course of dealing, course of performance, or trade usage. ETT, and its suppliers do not warrant that the software will meet your needs and be free from errors, or that the operation of the software will be uninterrupted. ETT, and its supplies do not warranty the accuracy of the reports generated. You also hereby acknowledge and understand that the products and services provided may operate, use, or be based on, in part or in whole, using advanced technologies including artificial intelligence. ETT has made every effort to accurately represent its products and services. The representation of the potential of the products and services offered is subject to the interpretation of ETT. You are responsible for any and all financial decisions you make, and it is your sole responsibility to discuss the legality or financial soundness of any decision you make with a qualified professional before making such a decision. The foregoing exclusions and disclaimers are an essential part of this agreement and formed the basis for determining the price charged for the products and services.

XI. INCIDENTAL DAMAGES

ETT and its suppliers will not be liable to you or any third party claimant for any indirect, special, punitive, consequential, or incidental damages, whether based on contract, negligence, strict liability, or other tort, breach of any statutory duty, indemnity, or contribution, or otherwise, even if advised of the possibility of such damages. ETT and its suppliers shall not be liable in any respect for failures to perform hereunder due wholly or substantially to the elements, acts of God, labor disputes, acts of terrorism, acts of civil or military authority, fires, floods, epidemics, quarantine restrictions, armed hostilities, riots, and other unavoidable events beyond the control of ETT or its suppliers, and the time for performance of obligations hereunder by ETT or its suppliers subject to such event shall be extended for the duration of such event.

XII. INDEMNITY

You agree to indemnify and hold ETT, its subsidiaries, and affiliates, and their respective directors, officers, agents, sponsors, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the products and services in violation of this Terms of Use Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above and/or if any content that you post on the website or through the services causes a related ETT entity to be liable to another.

XIII. U.S. GOVERNMENT REQUIRED DISCLAIMERS

These Terms of Use are subject to CFTC Rule 4.41. It states that hypothetical or simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, since the trades have not been executed, the results may have over-or-under compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown.

XV. CANCELLATION POLICY

In an effort to provide the best possible customer experience, should you for any reason be dissatisfied with your purchase of any ETT product or service, please send an email/letter or call to request cancellation of your account. When your account is cancelled, no further charges to your credit card will be made. ETT will not refund charges made prior to the cancellation request.
This Agreement will remain in full force and effect while you use any product or website of ETT. You may terminate your membership at any time for any reason. Your membership may be terminated for any reason at any time. If you are using a paid version of the services and your membership is terminated in the service because you have breached this Agreement, you will not be entitled to any refund of unused subscription fees. Even after your membership is terminated, certain sections of these Terms of Use will remain in effect.

XVI. NON-COMMERCIAL USE BY MEMBERS

Members on any ETT website are prohibited to use the services of the website in connection with any commercial endeavors or ventures. This includes providing links to other websites, whether deemed competitive to this website or not. Juridical persons or entities including but not limited to organizations, companies, and/or businesses may not become members of any ETT service and should not use the site for any purpose.

XVII. LINKS & FRAMINGS

Illegal and/or unauthorized uses of the products or services, including unauthorized framing of or linking to the websites will be investigated, and appropriate legal action may be taken.

XVIII. INTELLECTUAL PROPERTY

You hereby acknowledge that all rights, titles and interests, including but not limited to rights covered by intellectual property rights, in and to the website, and that you will not acquire any right, title, or interest in or to the site except as expressly set forth in writing. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from any of our services, software, or documentation, or create or attempt to create a substitute or similar service or product through use of or access to the programs or proprietary information related thereto.

XIX. ASSIGNMENT OF RIGHTS

Your rights of whatever nature cannot be assigned nor transferred to anybody or any entity, and any such attempt may result in termination of the associated Agreement, without liability to ETT. However, ETT may assign this Agreement to any person or entity at any time without notice.

XX. WAIVER

Failure of ETT to insist upon strict performance of any of the terms, conditions and covenants hereof shall not be deemed a relinquishment or waiver of any rights or remedy that may be held, nor shall it be construed as a waiver of any subsequent breach of the terms, conditions or covenants hereof, which terms, conditions and covenants shall continue to be in full force and effect.

XXI. SEVERABILITY OF TERMS

In the event that any provision of these Terms of Use is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms of Use shall remain valid and enforceable.

XXII. CHOICE OF LAW, JURISDICTION, AND FORUM

Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with your use of ETT products or services, or arising out of a provision in these Terms of Use is hereby irrevocably submitted to the exclusive jurisdiction of the courts of Colorado, to the exclusion of any other courts without giving effect to its conflict of laws provisions or your actual state or country of residence.
